Officer Maduro got behind the Toyota and turned on his patrol vehicle emergency lights just east of Santa Barbara Blvd at about the 100 block Cape Coral Parkway East. The Toyota continued traveling east, maintaining the same rate of speed, and then made a right turn onto Triton Court West, where it continued until coming to final stop in front of 4824 Triton Court West. Once the vehicle stopped, a white male driver immediately exited the vehicle and took off running. Officer Maduro began a foot pursuit while giving lawful commands for the male subject to stop. The male subject jumped into a nearby canal, where he swam towards the east, continuing to ignore my lawful commands to stop. The male got out of the canal and continued running towards Sorrento Court. Officer Maduro ran back to the vehicle where he found the female passenger, Ashley Lynn Shirley (W/F, DOB: 05/08/1993, 4913 Vincennes ST) outside the vehicle. Officer Maduro detained Shirley in handcuffs for the investigation. While conducting an area check, near the vehicle, Sergeant Causer located a green plastic pencil container in a nearby storm drain, containing two syringes, a spoon with a piece of cotton swab, alcohol swabs, several cotton swabs, and a piece of paper towel. Contained within was also a small clear plastic container with a clear bag of Methamphetamine and a clear bag of brown heroin. Shirley was charged with Possession of Methamphetamine, Possession of Heroin, Possession of Drug Paraphernalia, Resisting Law Enforcement Without Violence, and Permit Unauthorized Person to Drive. The suspect wrecked out on Hosea Dolphus Sr. Ave. about two blocks from where the officer terminated the pursuit. He then shot at a witness who tried to make him stop as he fled the scene on foot. The witness had a CHL and returned fire on the suspect. The witness was not hit and we do not believe the suspect was hit either. The incident remains under investigation. Anyone with information is asked to call the Department at 936-633-0356. #thanksfortheblinkerbuddy Dash Cam camera video released by the Lufkin Police Department captures a high-speed chase on Friday night. “The vehicle pulled to the side of the road as if it was going to stop, and about the time the officer was going to get out of his vehicle the suspect vehicle pulled away,” said Jessica Pebsworth, Lufkin Police Department Public Information Officer. That’s when the suspect vehicle accelerated speeds well over 100 mph and continued northbound on Loop 287 and then took a left onto Sayers Street. The officer pursued until the supervisor called off the pursuit due to it being in a residential neighborhood. “Whenever a pursuit happens there really is a case by case basis, there is different factors depending on the time of day, the weather, the area, if a pursuit does run into a residential area we usually terminate due to safety for the community,” said Pebsworth. Roughly two blocks away from where the pursuit was terminated the suspect vehicle crashed out on Hosea Dolphus Senior Avenue, hitting a witness vehicle. “The suspect fled on foot, a witness yelled at him to come back and actually ran after him and the suspect then turned and fired off a round at the witness and the witnessed fired back a shot at him in self-defense and the witnessed did a have a concealed handgun licensed,’ said Pebsworth. The Lufkin Police Department says other witnesses have been assisting in the incident. “There were a lot of people that witnessed this incident, the traffic incident and the shooting back and forth and so people have been cooperative, and we are just following up on those leads,” said Pebsworth. Law governing the society should always be fair, severe and timely. While fairness heralds impartiality with regard to social standing of the defaulter, severity of punishment is the intensity of retribution to ensure non-repetition of offense by the guilty and those harboring ill-will. Timely execution of the law again has its own importance. Going on with the adage Justice delayed is justice denied, when/if it takes forever in the proceedings to punish a single criminal, it adds to the confidence of other miscreants. The reason social ills like indiscipline, unaccountability and the "devil may care" attitude remains adamantly entrenched in the society is due to lack of proper authority to efficiently and effectively sentence the culprit.

Of late, people in general have become far too individualist. This self-centeredness has by far overshadowed any sense of consideration for others. The decadence is more conspicuous with us Nepalese and our deteriorating sense of nation and nationality in that we seem to have gone completely oblivious to our civic responsibility and our basic obligation as an inhabitant of the country. Why is it so hard to realize that If the nation itself ceased to exist, it would also rid us of our individuality? Why are we so hell bent on destroying our own nation as a result of our growing apathy towards it?

With each forward step all other countries in the world are taking in the path of self sufficiency and sustainable development, we seem to be retreating to the uncivilized era of the yore. Corruption laced politicians and bureaucrats, incompetent professionals and professors, bickering trade unions and transport agents, student hooliganism, yellow journalism, inefficient law and justice, tainted security system all paints a picture of the society where majority of people are ever struggling to make their ends meet. Their potentiality and creativity are crushed under massive boulders of poverty and scarcity. Development works are near stagnant and economy is in doldrums. Kathmandu, the sole metropolitan city of Nepal is one of the ugliest capital cities in the entire world. Garbage heaps, littered roads and alleys, lack of even the most basic facilities like proper drinking water and drainage system, non-existent street lightings and public toilets, inadequate/improper roads, undisciplined traffic, excess particle pollution, and everything that sounds unruly and spells mayhem horrendously haunts the very existence of humanity here. All this makes us wonder why the globe tottering politicians who never tire hopping from one junket to another in one pretext or the other are never ashamed of the pathetic condition of their own motherland? Does their conscience never question their incompetency? Or are they so blinded by greed for green to care less since each international visits made only means more opportunity to beg for increased assistance by showcasing the grotesque state of the country?

Us Nepalese have been tricked, ridiculed, robbed and played upon our sentiments by political figures innumerable times. In spite of this, we keep on treating them as our mentor. We are never tired of clamoring around them all eyes and ears nodding ludicrously and applauding with gaiety their wild oratory. This is despite our full knowledge that most of their wanton and hallow wag of tongue are nothing better than well devised means to beat a path to power for furthering their individual vested interest. While the country has been reeling under derogatoriness and disarray for decades, we do nothing to punish these degenerates. So truly had the great Napoleon Bonaparte once stated "The world suffers a lot not because of the violence of bad people but because of the silence of the good people".

I know it is far easier to criticize than to create. Fact remains, the disorderly picture often portrayed of our country can gradually be corrected. The only hindering factor here seems to be absence of determination of all concerned and the imperative change of mindset from condition of stagnation to creation and construction. Nepal is a country where natural bestowment is diverse and in plentiful, where resources still remain unexploited and unexplored, and where ways are many but will is nil. The continual whining and crying over the half-emptiness of the glass instead of trying to make most out of the other half that is full has been the major roadblock in the path of perfection for Nepal. Let's face it; a beggar can never attain any progress in his life if he continues to be dependent upon the mercy of others.

Today, Nepal is more in need of social/economical transformation than in any other past. And, for transformation to take place, there should initially be a break in tradition, in the old ways of thinking and in old paradigm. Let us all learn to love and respect our nation and fellow inhabitants first. This accomplished, we shall not only automatically build our civic sense which we are so in dire need of, but also pave way in sorting out myriad of other problems presently gnawing our nation. Finally, in order to ensure effective curbing of crimes, need for stringent legal measures cannot be overemphasized. Authorities should be made accountable for their actions or the lack of it with zero tolerance in taking disciplinary measures against the culpable. Only then can our nation hopefully reclaim its lost pride and glory.

Mr Pitt, 24, originally from Leighton Buzzard, was shot dead at Tracey Court in Hibbert Street, Luton, on November 9, 2016. Armed officers had been called to the after Mr Pitt imprisoned his girlfriend. After an attempt to taser him failed, Mr Pitt reportedly came at the officers while armed with kitchen knives and died from a single shot. The inquest is expected to conclude next Tuesday.

Shortly before 11 p.m. Taylor had entered the lobby of the jail carrying a long metal pipe and two metal stakes. He left after Orange County sheriff’s staff told him to leave. Then, at about 11:30 p.m. he was spotted at the parking structure by a witness who saw him trying to break into cars while still carrying the metal objects. The witness called 911 and the officer who arrived — Officer Gavin Roelofs — commanded Taylor to put the pipe down. He did not comply so the officer discharged his Taser at Taylor who was not affected by the impact. Taylor appeared to reach for the Taser probes and pulled one out before the officer fired his weapon and hit the suspect twice. Officer Nathan Gibson followed policy and the law when he fatally shot Isaiah Ramirez, 36, of Clinton, the night of Oct. 8, authorities said earlier this month. ORPD Officer Gibson shot the Clinton man twice through his Nissan pickup truck's windshield. The third bullet struck the steering column, according to an investigation of the shooting. Anderson County District Attorney General Dave Clark cleared Gibson earlier this month of wrongdoing, and no charges will be filed. Investigative Hypnosis: Is It Effective Or Completely Bogus?

Way back in the 1970’s when I was a college student studying criminal justice I participated in a student practicum at the local sheriff’s office. Most of my "work" consisted of going through stacks of crime reports and calling back theft victims to reassure them that even though the sheriff’s office had not yet been able to figure out who stole their property and the likelihood of them ever getting their stolen property back was minimal, the sheriff’s office was "still on the case." It was more of a public relations effort to make people feel that the sheriff’s office had not forgotten about their case and was concerned that they had been a crime victim.

To my surprise, most people appreciated the follow-up. They understood that the sheriff’s office was doing what they could and in a few cases the victims provided new suspect information that could aid in the investigation. Some told me they understood there was little the sheriff’s office could do and suggested that the sheriff’s office discontinue investigating their case and concentrate on more serious crimes. Others told me that they had already figured out who stole their stuff and had recovered it themselves. Excellent – case closed!

On one occasion a detective asked me if I would like to assist him in a Hypnotism Session. He explained that there had been a "grab-and-run" theft at a jewelry store and an elderly lady saw the thief run from the store and get into a waiting get-a-way car. This lady could not remember much about the get-a-way car and the detective was hoping that under hypnosis she could provide a good description of the car and maybe even a license plate. This sounded much more exciting than calling and propitiating theft victims, so I jumped at the opportunity.

The hypnosis session occurred in a small quiet room at the sheriff’s office. I have no clue as to the training this detective had at the time, but since investigative hypnosis was in its infancy in those days, I suspect it was minimal. The lady sat in a big comfortable office chair and the detective sat in a smaller chair in front of her. The detective dimmed the lights and spoke to her in a soft tone and directed her attention to the incident. His words got slower and softer and it appeared as if he was trying to get her to totally relax. At one point he asked her to close her eyes and continue listening to him. It was surreal – almost right out of the movies!

I sat in the back of the room with a pen and pad in hand. My job was to write down anything pertinent the lady might say. After about 10 minutes of soothing words, the lady was able to recall the color of the thief’s get-a-way car (bright red) and gave a general description of a sedan. Surprisingly, she was able to slowly and deliberately "recall" the license number. I dutifully jotted it down.

After the session was over, the detective asked me what I thought. I said I didn’t know, but silently I thought she was faking it . . . but you never know. It turns out that two other credible witnesses described the thief’s car as blue, so it was likely not red. Also, the license plate information turned out to belong to a truck that had been crushed in a junk yard years before. The hypnosis session was certainly interesting, but it produced NO credible leads. In fact, it produced FALSE leads.

MYSTERIOUS and Controversial

Hypnosis can be traced back to ancient Egypt and has always been surrounded by mystery and controversy. During the last 20 years the use of hypnosis in criminal investigation has dramatically increased and acceptance has varied from jurisdiction to jurisdiction. In very simple terms, the intent of investigative hypnosis is to aid a crime victim or witness in recalling important information that their mind has repressed. Investigators can then follow-up on this information and hopefully solve crimes that were likely otherwise unsolvable. It is not intended to be a tool for extracting "the truth" from suspects or for coercing witnesses into fabricating information.

Today there are numerous classes, seminars, and other trainings that teach investigators (both law enforcement and private investigators) the science behind investigative hypnosis, how to do it properly, and the legal and ethical issues associated with using hypnosis in an investigation. A typical training might include (at a minimum) training in:

PSYCHOLOGY of eyewitness testimony

Procedures for obtaining identification evidence

Field studies of eyewitness memory of actual crimes

Traumatic Memory and Ordinary Memory

Criteria-based statement analysis

Investigative Memory Enhancing Techniques

Legal issues associated with hypnosis including the admissibility of hypnosis-derived evidence.

LEGAL Issues Abound

Today most investigators agree that in some situations investigative hypnosis, like polygraph testing, can be a useful tool in investigating some crimes. Often it is used as a last resort when all leads have been exhausted and the crime remains far from being solved.

But, acceptance of hypnotic induced testimony from witnesses and even investigator follow-up based upon hypnotic induced statements, has been scrutinized carefully and sometimes skeptically, by courts. Every situation is different and case law in many U.S. States is continually evolving, but the general rule is that SOMETIMES hypnotic induced testimony, or investigator actions that flow from it, are accepted in court and SOMETIMES it is not. How’s that for a clear legal line that only a lawyer could appreciate!

In a published article, the respected Journal of the American Medical Association expressed a position paper that stated "The Council finds that recollections obtained during hypnosis can involve confabulations and pseudomemories and not only fail to be more accurate, but actually appear to be less reliable than nonhypnotic recall. The use of hypnosis with witnesses and victims may have serious consequences for the legal process when testimony is based on material that is elicited from a witness who has been hypnotized for the purposes of refreshing recollection." (JAMA 1985; 253:1918-1923)

The general proposition that pre-trial statements made under hypnosis are hearsay and unreliable and therefore not generally admissible, is followed by most courts. See Creamer v. State, 232 Ga. 136, 205 S.E.2d 240 (1974); Emmett v. State, 232 Ga. 136, 205 S.E.2d 231 (1974); State v. Pierce, 263 S.C. 23, 207 S.E.2d 414 (1974); Greenfield v. Commonwealth, 214 Va. 710, 204 S.E.2d 414 (1974); State v. Conley, 6 Kan. App.2d 280, 627 P.2d 1174 (Kan. Ct. App. 1981); and State v. Beachum, 97 N.M. 682, 643 P.2d 246 (1981).

And in some states, all testimony from a person whose memory was "refreshed" by hypnosis is prohibited. In the case of State v. La Mountain, 125 Ariz. 527, 611 P.2d 551 (1980), the Arizona Supreme Court stated: "Although we perceive that hypnosis is a useful tool in the investigative stage, we do not feel the state of the science (or art) has been shown to be such as to admit testimony which may have been developed as a result of hypnosis. A witness who has been under hypnosis, as in the case here, should not be allowed to testify when there is a question that the testimony may have been produced by that hypnosis."

But consider a ruling from the North Dakota Supreme Court in the case of the State of North Dakota v. Joseph Lesley Brown. 337 N.W.2d 138 (1983). The court stated "The major issue raised on appeal is whether or not a witness whose memory has been previously enhanced through the use of hypnosis may testify in a criminal trial in North Dakota. We conclude that a witness who has previously been hypnotized is not rendered incompetent to testify. Rather, we hold that hypnotism affects the credibility but not the admissibility of such testimony."

Other court cases, with different variations of these decisions, abound.

In my home State of Oregon, there is yet another twist to the legality of testimony elicited under hypnotism. Oregon has a long-standing statute that allows witnesses who have been subjected to "hypnosis" or "mesmerism" prior to trial, to testify for either side in a criminal trial if the entire hypnotic procedure is "recorded on either videotape or any mechanical recording device." The statute further requires that "the unabridged videotape or mechanical recording shall be made available to the other party or parties." See Oregon Revised Statute (ORS) 136.675. This seems to follow the North Dakota Supreme Court reasoning that witnesses who have been previously hypnotized are not incompetent to testify and it is up to the jury (or judge in the case of a Court trial) to assess the credibility of that testimony.

SUMMARY

Using hypnosis to help victims and witnesses recall information can sometimes aid an investigator in an investigation. It is being used with increasing frequency by law enforcement and private investigators but is still viewed skeptically by many courts. Usually, it is only used when investigators have exhausted all leads and the case would likely end up in the cold case file unless new leads can be developed. In private investigations, qualified investigators sometimes use hypnosis to recover memory for civil or criminal trials and it is also used to help investigators find lost or misplaced property.
